Can transport damage caused by container condensation be covered by cargo insurance? This has been decided in a recent decision from the Maritime and Commercial Court. A Danish importer bought various pieces of applied art from a supplier in Indonesia, including wooden sculptures, clay pots and sandstone figures. Upon arrival it was clear that there had been water or moisture damage to the goods. The importer had taken out cargo insurance for the goods on Danish conditions. As the insurer denied coverage the insued brought proceedings and submited that the loss was covered under the policy.
