Can transport damage caused by container condensation be covered by cargo insurance? This has been decided in a recent decision from the Maritime and Commercial Court. A Danish importer bought various pieces of applied art from a supplier in Indonesia, including wooden sculptures, clay pots and sandstone figures. Upon arrival it was clear that there had been water or moisture damage to the goods. The importer had taken out cargo insurance for the goods on Danish conditions. As the insurer denied coverage the insued brought proceedings and submited that the loss was covered under the policy.

Can CMR cases be settled by arbitration if there is no express reference to the CMR Convention in the arbitration agreement?

In Denmark, disputes related to CMR transportation are rarely resolved through arbitration. This is due, among other things, to the fact that, in many cases, there may be a need to involve sub-carriers in a liability case concerning cargo damage that occurred during CMR transportation. This would be challenging if arbitration has been agreed upon between the transport customer and the contracting CMR carrier. However, arbitration can be adopted if the arbitration clause states that the dispute will be resolved according to the CMR Convention. The judgment in this case indicates that it may validly be agreed that disputes should be subject to arbitration even if there is no explicit reference to the CMR Convention in the arbitration agreement, if the agreement states that the court will decide the dispute according to legislation corresponding to the CMR Convention

Is it possible to interpret the Danish Road Traffic Act in accordance with the Motor Vehicle Insurance Directive to determine liability?

The Supreme Court held that a fire engine used for firefighting in a field was in use as a vehicle, and that any personal injury caused by the fire engine in this connection was covered by the motor liability insurance. This case concerned the demarcation between commercial liability insurance and motor liability insurance, and whether it is possible to interpret section 105 of the Danish Road Traffic Act in accordance with the directive in relation to article 3(1) of the Motor Vehicle Insurance Directive.

Determining liability and number of parcels in shipment

The case discussed in this article concerns a dispute around a compensation claim that arose after water entered a container and damaged the shipment within. The judgement in this case is an expression of the general rule that a carrier cannot, by filling in boxes in a transport document, determine how many parcels a shipment includes when calculating a liability limitation amount in accordance with section 281 of the Maritime Act.

Is the air carrier entitled to freight if the transport of the goods is not carried out?

In the case discussed in this article, the Court considered whether a provision that freight must be considered earned, regardless of whether the goods are not delivered at the destination, must be understood as meaning that the carrier is entitled to freight, regardless of the reason for the non-delivery. In the case in question, the freight forwarder had handed over the goods to the air carrier late.
