When a shipper instigates a direct claim against a subcarrier who has performed the transport, the question arises whether the shipper must respect a jurisdiction clause in the subcarrier’s transport document, even though no contractual relationship exists between the parties. T

This questions was addressed and decided by the Danish Maritime and Commercial Court in a new judgment dated 21 February in case BS-19711/20223-SHR.
